Federal efforts to stop Texas from policing its own borders come as massive hordes of migrants enter the US illegally.
Joe Biden’s Department of Justice has threatened to sue Texas Gov. Greg Abbott (R) if he enforces a recently-passed law allowing state and local law enforcement officials to arrest illegal immigrants.
In a letter to Abbott from Principal Deputy Assistant Attorney General Brian M. Boynton, the governor was notified that “the United States will pursue all appropriate legal remedies to ensure that Texas does not interfere with the functions of the federal government.”
Citing a 2012 Supreme Court ruling, the DOJ litigator asserted the federal government has authority over immigration and that Texas’ law “therefore intrudes into a field that is occupied by the federal government and is preempted.”
“Indeed, the Supreme Court has confirmed that ‘the removal process’ must be ‘entrusted to the discretion of the Federal Government’ because a ‘decision on removability’ touches ‘on foreign relations and must be made with one voice,’” the DOJ wrote.
The fed’s threatening letter comes as Abbott signed a law earlier this month allowing state police to arrest migrants who crossed the U.S.-Mexico border illegally.
The law, called SB 4, would take effect in March 2024 and codifies illegal entry or re-entry into Texas as a crime, with penalties ranging from 180 days in jail to 20 years in prison.
“President Biden’s deliberate inaction has left Texas to fend for itself,” Abbott declared during the bill’s signing.
The new law rankled Mexican President Andres Manuel Lopez Obrador, who accused Abbott of performing the stunt for political gain.
