Illegal from El Salvador with several prior DUI arrests fatally crashed truck into vehicle carrying mom and child.

An illegal immigrant from El Salvador who’s previously been deported four times is accused of killing a mother and her teen son in a drunk driving collision in Colorado.

On December 12th, 37-year-old Jose Guadalupe Menjivar-Alas was charged with DUI, vehicular homicide, and habitual traffic offenses for crashing his truck into a vehicle near a high school at an estimated 100 miles per hour, resulting in the deaths of Melissa Powell, 47, and her 16-year-old son, Riordan.

The Broomfield Police Department at the time said they would conduct a toxicology exam, but that they “believed alcohol and speed were contributing factors.”

Police reportedly located two empty cans of beer on the truck’s floorboard, and a blood test at a local hospital revealed Menjivar-Alas’ blood alcohol content exceeded the legal limit by three times.

A U.S. Immigration and Customs Enforcement (ICE) rep told Fox 31 Denver Menjivar-Alas is a recidivist who’d already been deported several times over the past two decades. 

Despite a judge issuing a final deportation order on April 14, 2009, he was subsequently located within the US and removed in June 2012, November 2014 and January 2015. 

“ICE records show that the subject has been previously removed and has no regard for immigration law,” ICE told FOX 31 in a statement. “As part of its routine operations, ICE targets and arrests noncitizens who commit crimes and other individuals who have violated our nation’s immigration laws. All noncitizens in violation of U.S. immigration law may be subject to arrest, detention and, if found removable by final order, removed from the United States, regardless of nationality.”

ICE again placed an immigration detainer on Menjivar-Alas on Dec. 18.

TND reports “the man also has a record of four other alcohol-related driving offenses stemming back to 2007.”

To top it off, the Boulder District Attorney’s Office had asked for Menjivar-Alas to be jailed for one year just four days before the fatal crash, arguing he posed a danger to the community.

However, after considering other factors including previous time served, a judge at the Dec. 8 hearing instead let Menjivar-Alas off on a one-year work release and a two-year probation sentence, along with a suspended three-year jail sentence.

“The Court allowed the defendant to wait out-of-custody for a bed in the work release program — over our office’s objection,” the Boulder DA’s office explained in a statement to Fox 31. “The one year of work release would have required the defendant to remain in the jail except when authorized to leave for work.”

The repeat offender was undeterred from re-entering the US because he knew the system is completely broken, and many other criminal illegals similarly exploit America’s immigration laws in the exact same way.

Securing America’s borders would allow immigration authorities to filter out criminals and better protect innocent citizens.
